Royal Enfield ternyata melanggar hukum dengan menjual Pegasus 500


Konflik antara pembeli Pegasus 500 dengan Royal Enfield masih terus berlanjut. Kali ini informasi datang dari pemilik motor Pegasus 500, Anuj Singh. Ia mengajukan surat minta jawab ke pemerintah India dengan RTI (Right To Information):

Yang ditanya adalah soal fitur yang wajib ada di motor yang dijual di India. Penjualan motor Pegasus 500 itu disebutkan merupakan pelanggaran hukum karena seharusnya motor di India yang diproduksi sesudah 1 April 2018 harus wajib dilengkapi dengan ABS (untuk 125 cc ke atas). Dulu soal pelarangan ini sempat diberitakan di Indonesia berkaitan dengan ekspor Yamaha R3. Yamaha R3 harus dihentikan penjualannya karena motor masih belum dilengkapi ABS.

Namun ternyata motor Pegasus 500 bisa dijual tanpa ABS. Dan ini yang menjadi pertanyaan media juga.

Yang aneh, pertanyaan dari Anuj Singh tersebut terkesan menanyakan apakah melengkapi motor dengan ABS harus minta ijin dulu.

1. Is any ABS fitment approval is taken by Eicher motors Limited / Royal Enfield India for Indian 2 wheeler Royal Enfield bikes from ministry of road transport and highways so Eicher motors Limited / Royal Enfield India can provide ABS features to Indian customers in 2 wheeler bikes.
2. When did Eicher motors Limited / Royal Enfield India applied for ABS fitment request in Indian 2 wheeler Royal Enfield bikes to ministry of road transport and highways.
3. When did Eicher motors Limited / Royal Enfield India received the approval from ministry of road transport and highways to provide ABS in Indian 2 wheeler Royal Enfield bikes.
4. Is there any regulation / notification / restriction from ministry of road transport and highways for Automobile Industries in India that they can not not provide the ABS feature in 2 wheelers / 4 wheelers before the approval from ministry of road transport and highways.
5. What is ministry of road transport and highways regulation / notification for Automobile Industries to fix ABS system in 2 wheeler bikes already on road and running without ABS. Is there any time line to retrofit the ABS in 2 wheelers already running on road without ABS.

Undang undang di India mewajibkan setiap motor baru harus pakai ABS.
Is it compulsory to have ABS in bikes from 2018?

As per the government’s regulations, any new model launched on or after April 1st, 2018 is required to have ABS. Existing models in the market will have till 2019 to be upgraded.
